The current Agreement contains the terms and conditions applicable to the end user and Meska Limited (West Wing, 2/F, 822 Lai Chi Kok Road, Lai Chi Kok, Kowloon, Hong Kong ? Business Registration no. 67538426) regarding all the services provided through the online platform www.coweddy.com. The access and use of this platform constitutes implicit adherence to the terms and conditions described herein.To contact Coweddy.com please write to firstname.lastname@example.org.
For the interpretation of these terms and conditions, the following definitions are to be considered:
SITE: it means Coweddy web site (www.coweddy.com) or the application of Coweddy for mobile devices;
CONTENT: photos, images, texts, documents, upload (content uploaded to the platform) or information stored on the site, software, music, audio, video, documents, data or other materials;
COUPLE: it means the engaged couple ? also called newlyweds - creating an event on www.coweddy.com offering opportunities to third parties to take part in their wedding;
COWEDDER: This refers to the user who asks to take part in a wedding available on www.coweddy.com;
GIFT: financial contribution required to Cowedders to take part in a wedding;
WEDDING: it refers to the bride and the groom's wedding - also called "event" - who provide some places for Cowedders giving them the opportunity to participate in it;
USER: anyone who completes the registration to Coweddy;
SERVICES: it means any service offered on the site;
SUPPLIERS: it means external agents, suppliers, distributors, dealers or sponsors.
The present Terms and Conditions constitute a legally binding agreement between the user and Coweddy and supersede any prior or contemporaneous agreements, declarations, warranties and arrangements regarding the site, the content and services provided on the site and the object of this Agreement. These Terms and Conditions can be univocally modified without prior notice by Coweddy in considerations of the changes that may occur during construction, therefore each user of this site agrees to view them regularly. The people wishing to become Coweddy Newlyweds and therefore have the possibility to get in touch with Cowedders are expected to read these conditions of use before using our website and the services offered. When accessing this site or using any part of the site or the content or services provided therein, the user understands and accepts these terms and conditions. If the user does not agree with these terms, he/she will have to refrain from obtaining information and continuing to use this website. The Terms and Conditions published on the website are the updated version: the user is required to read the text carefully and in its entirety before using the site and the services offered therein.
This web site, including its tools, applications and services, are intended exclusively to be accessed and used by people whose legal age is OVER EIGHTEEN (18). The user accessing our website, including related tools, applications and services, declares and guarantees to be at least EIGHTEEN (18) years old and to have full powers, rights and capacity to enter into this agreement and to abide by all its terms and conditions.
Coweddy is an online portal that makes available to Cowedders the opportunity to request to participate in a wedding arranged by the Newlyweds through an online booking service. The Cowedders can connect to the website and see the weddings of the Newlyweds available to host them at their marriage in exchange for a Gift that is a fee intended to decrease the event organization costs. The subject of Coweddy's commercial activity is selling an online booking service on behalf of the couple for the participation of the Cowedders in their wedding. Coweddy.com is not a tour operator, it does not own, sell, resell, provide, manage and/or control any transportation or tour services. Coweddy.com responsabilites are limited to: (1) providing the availability of the booking service and (2) accepting payments from Cowedders on behalf of the Couple. Coweddy does not act as agent or insurer and it is not a party to any agreements between couples and travelers.
The site and its services are an online platform through which the newlyweds can create advertisements meant to provide the possibility for Cowedders to become aware of this opportunity and make use of it. The user acknowledges and accepts that Coweddy does not take part in the agreements between the Cowedders and the bride and groom. Coweddy has no control over the Cowedders conduct during the weddings nor on any other user of the site or services and disclaims all liabilities in this regard. Coweddy exercises neither prior control nor subsequent surveillance during the event. The user agrees to use the site and its services in accordance with the laws, rules and regulations applicable in their country of residence and, in any case, in good faith and according to the so-called due diligence. It si possible to visualize, download and print pages or other contents of the site for personal use always respecting the restrictions set out below and elsewhere in the current agreement.
a) refrain from the use of our site, including related services and tools, if you do not have the power to sign contracts with legal validity or if you are not EIGHTEEN (18) years old yet. In this case, the access to our site and its services or tools is prohibited on a temporary or permanent basis;
b) it is forbidden to upload information, elements, messages and inappropriate contents which do not meet the common sense of decency or prove to be offensive to other people;
c) It is forbidden to use this site for commercial purposes, except with written permission signed by Coweddy;
d) it is forbidden to reproduce, plagiarize, distribute, publicly communicate, publish, rent, republish, sell or sublicense any material of this website, including redirecting to another site;
e) once finalized the booking for the participation in the wedding through the Coweddy platform, the user is required to pay the service fee to Coweddy;
f) it is forbidden to collect, disclose or transfer in any way information or personal data either of the members or of the users;
g) it is forbidden to use the Website or its services for purposes other than those provided by the web site such as work requests or contact the users to carry out activities for third parties, companies or agencies;
h) It is forbidden to post any false, inaccurate, misleading, defamatory or libellous information;
i) It is forbidden to use our website in any way in order to cause, even potentially, damage to the site or endanger the availability or accessibility of the site, either illegally, fraudulently, harmfully or in connection with any illegal, harmful or fraudulent activity.
Coweddy reserves the right to close or delete a user account in case of violation of the prohibitions mentioned above or even without any particular reason.
The cost of the online booking is calculated on the total of the service requested by the bride and groom (Gift) with the application of a net percentage amounting to 20%. The service fee is a percentage applied to the total value of the reservation to cover the payment processing costs, provide timely service to users and maintain the site active and functional. The cost of the online booking service is entirely charged to the Newlyweds. Should the Cowedder user, further to the booking confirmation and payment of the Gift, renounce the participation in the wedding, the following conditions apply: If the cancellation is made up to 30 days before the date of the wedding, the Cowedder is entitled a refund of the full amount paid, net of the expenses related to the transfers of money and a cancellation penalty amounting to 5% of the Gift, to cover the processing and booking costs. If the cancellation is made between 30 and 10 days before the wedding date, the Cowedder is entitled a refund amounting to 40% of the Gift, net of expenses related to the money transfer operations, to cover the processing and booking costs. If the cancellation is made within 10 days before the wedding or in the case where the Cowedder should not take part in the wedding, the Cowedder has no right to any refund. In the latter case, the bride and groom are entitled to 80% of the Gift, net of expenses of the money transfer operations, such as reimbursement of organization expenses already incurred. Coweddy returns the Cowedder the full amount already paid in case the event is cancelled. The bride and groom have 48 hours to confirm or reject the Cowedders request of participation. In the event of inaction on the part of the newlyweds, beyond 48 hours the reservation will be cancelled. In turn, the Cowedder has 48 hours to pay the prescribed amount (unless extended at the discretion of Coweddy staff). If either party is unable to meet its commitments with this Agreement because of circumstances beyond one's control or in any case not attributable to one of the parts, such as but not limited to, lightning, flooding, extreme weather phenomena, fires, explosions, wars, civil unrest, strikes (even not in association with its employees) or acts of local or central government or other competent authorities or events that go beyond the control of its suppliers, this Party shall not be liable for non-performance to the other Party. Coweddy retains the amount paid by the Cowedder until after the wedding. Once the event is concluded, Coweddy will pay the bride and groom the agreed amount, retaining the sales percentage of the online booking service. Coweddy will pay the newlyweds the agreed sum through the "Paypal" bank transfer payment system according to the bank details provided by the bride and groom during the registration, no later than a maximum of 5 working days from the conclusion of the event, except in case the wedding hasn't in any way respected the description provided on the site and when this causes grave complaints from Cowedders. Before the wedding the bride and groom have to provide their bank details so that Coweddy may make the transfer of money and it is their responsibility to provide the correct bank details. It is also required to communicate their tax code for the correct execution of the payment and invoice issuing for the Coweddy service costs. Coweddy is not responsible for crediting of funds once the money has been transferred to the account provided by the newlyweds. Coweddy does not pay the bride and groom, cannot be considered as a withholding agent, nor acts as an employer. Coweddy's exclusive object is selling online booking services. The amounts collected by Coweddy and subsequently issued to the bride and groom only constitute a transitional account guaranteed to users and do not represent either an income or a cost. The tax and social security obligations and requirements as a result of Coweddy services are the sole responsibility of the bride and groom as well as the user owner's as part of their agreements.
The Cowedder may terminate the Agreement at any time. The details relating to cancellations and refunds are specified in clause 6. Coweddy is in no way responsible for any disputes arising from the cancellation and refund procedures.
All the notifications and communications pursuant to this Agreement must be made in writing and by electronic mail as follows: a) to the e-mail address support@Coweddy.com in case of cancellation; b) to the addresses indicated by the users in case of exchange of information between the Newlyweds and the Cowedders.
The user agrees to indemnify and not hold Coweddy, our affiliates, officers, directors, agents, lawyers, partners, employees and other partners liable for any claims, including legal fees, for acts of (i) people not related to the contents submitted, posted, transmitted or put at our disposal and (ii) of the users, bride and groom or third parties arising from a transaction through Coweddy (including but not limited to, damage or loss of personal property or real estate, personal injury, death, illness or death of the Cowedder, or infringement of any law).
The user agrees and ensures, within legal limits, to take on all the risks deriving from the access and use of the website, the application and services offered and the collective content of one's advertisement or booking of any service on the site, as well as any contacts with other Coweddy users, both in person and online. Neither Coweddy nor any other party involved in the creation, production or supply of the website, application, services, collective content will be responsible for incidental, special, exemplary or consequential damages, including loss of profits, data or start-up, service interruption, damage to computer systems or system errors, or the cost of replacement products or services, nor for any personal, physical or psychological injury arising from these terms or bound to them, and resulting from the use or inability to use the web site, application, or service of one's advertisement or booking of any service through the site, applications and services, whether based on warranty, contract, fault (including negligence), product liability or any other legal theory, even if Coweddy is informed of the possibility of such damages, arising out of or in connection with: (A) any dispute with any other user of the website or service; (B) the replacement cost of products, services or information acquired or obtained as a result of information obtained or transactions made through our site; (C) the disclosure, the unauthorized access or alteration of its content; (D) any injury or damage suffered by the user or any third party (including for example, relatives, friends, animals and other related parties); (E) any injury or damage suffered by pets; (F) any loss or damage to either perosnal or real estate properties; (G) any other circumstances arising from, related or linked to our services or these conditions. Coweddy is not responsible for any errors or delays in the execution of these conditions, whether due to employees or causes beyond our will. The user will not hold Coweddy, its service providers and each of their respective agents, directors, officers, employees, information providers, service providers, suppliers, attorneys, licensors and licensees, and all other persons associated liable for all the rights, claims, litigations, requests, legal actions, proceedings, obligations, liabilities, legal fees, costs, and disbursements of any nature whether known or unknown, arising from, related and/or connected to the use of the site, its content and/or service. Coweddy shall not be liable for any damages of any kind caused by a Cowedder.
This Agreement shall be fully in force and effective as long as the user continues to use the site and its services. The user may cancel one's account and cancel the subscription at any time for any reason by contacting us exclusively at info@Coweddy.com. Coweddy can unsubscribe any user for any reason and at any time. Some sections of the current Agreement will remain in force even after canceling a user account. Coweddy reserves the right to unilaterally change these sections. Any changes by the users to the event relevant information can be done by accessing one's own account until and no later than the booking date and the payment made by the first Cowedder participating in the event. The refund conditions in clause 7 remain unchanged.
THE USE OF THE SERVICES OFFERED ON COWEDDY IS AT ONE'S OWN RISK. THE SERVICE PROVIDED BY COWEDDY IS PROVIDED "AS AVAILABLE" ( "AS IS"). WE DISCLAIM, AND THE USER EXPRESSLY DISCLAIMS, ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED INCLUDING, FOR EXAMPLE, THE IMPLIED WARRANTIES OF MERCHANTABILITY, ELIGIBILITY FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT REFERRED TO THE SERVICES, INCLUDING THE INFORMATION AND MATERIALS CONTAINED HEREIN.WE NEITHER DECLARE NOR GUARANTEE THAT (A) OUR SERVICES MEET THE USER'S REQUIREMENTS, (B) OUR SERVICES ARE UNINTERRUPTED, APPROPRIATE, SECURE OR ERROR-FREE, (C) ANY INFORMATION OBTAINED THROUGH OUR SITE IS ACCURATE OR RELIABLE, (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY THE USER THROUGH OUR SITE MEETS THE EXPECTATIONS, (E) ANY INFORMATION PROVIDED BY THE USER IS NOT SHARED WITH THIRD PARTIES, OR (F) ANY INFORMATION OR SOFTWARE ERRORS MAY BE CORRECTED. THE ACCESS OR TRANSMISSION OF ANY CONTENT OR INFORMATION THROUGH THE USE OF THE SITE IS UNDER ONE'S OWN RESPONSIBILITY AND RISK.THE USER IS SOLELY RESPONSIBLE FOR ANY LOSS OR DAMAGE ARISING FROM SUCH ACCESS OR TRANSMISSION. THEREFORE, THE USER IS BOUND TO USE RECOGNIZED SOFTWARE TO DETECT AND REMOVE ANY VIRUSES FROM ANY CONTENT DOWNLOADED FROM PETME. NO DATA, ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN OBTAINED THROUGH OUR SERVICES WILL RESULT IN ANY WARRANTY UNLESS SPECIFICALLY INCLUDED IN THESE TERMS.
Coweddy allows its users to get connected and exchange services, information, messages and photos related to the wedding. To ensure the continuity of open access to such services and materials, Coweddy protects the rights of those who share information on the site. The materials and information available on the site are exclusive property of www.Coweddy.comm and are protected by copyright, registered trademarks and other intellectual property laws. The user undertakes not to use them in any way without Coweddy's prior written consent. The user does not acquire any ownership of such rights. In addition, it is forbidden to remove or obscure the copyright notice or other notices contained on the website or in any element which can be downloaded from it. The user acknowledges all the rights and any information including, for example, all the rights protected by the law of intellectual property about and for the site, and agrees not to acquire any rights, titles or interests in or to the site, except what expressly indicated in the current Agreement. It is strictly forbidden to modify, adapt, translate, create derivative works, decipher, de-codify, disassemble or try to obtain the source code of our services, software or documentation, or create or try to create a substitute or similar service or product through the use of or access to the program or its proprietary information.
The user commits not to disclose the information obtained by/through us and by/through our users, advertisers, suppliers and Coweddy members. All the information sent to an end user is to be considered as Coweddy exclusive property information.
The current Agreement shall be governed and interpreted according to the laws of Hong Kong Special Administrative Region of the People's Republic of China. You agree to submit to the non-exclusive jurisdiction of the Hong Kong court.
